Regulations of the Colorato Bulent Parlak

General terms and conditions

The following terms and conditions apply for:

Between Bulent Parlak conducting an economic activity under the name Colorato Bulent Parlak and having its registered offices in Poznan, ul. Swarożyca 14A, 61-615 Poznań, Poland, under tax identification number 9721171038, statistical identification number 301027233, hereinafter referred to as the printing house and the customer.
By customer is meant a legal person or an organizational unit without legal personality who has the capacity in their own name to have rights and undertake legal obligations, and further more a natural person conducting a business activity or professional activity who does not have legal capacity in managing one own’s business or professional activity.

Customer is forbidden to:

  • Take advantage of the printing house in any way that is unlawful to the common law and this Regulations
  • Communicate to printing house illegal content, that is, content which violates the law or third party personal rights
  • Use the graphics without having the copyrights to them
  • Send commercial information that has not been ordered

Those rules do not apply to customers within the meaning of the provisions of the Code of Civil Procedure.
Person placing an order on behalf of the customer declares to possess powers to represent the customer and to contract liabilities on his/her behalf. All the information about the products and services on the Website in accordance with art. 71 of the Civilian Code constitute only an invitation into a contract. The acceptance of provisions contained in these Regulations is a prerequisite of placing an order for products and services of the printing house.

Customer orders
The orders can be made by electronic means in the form of an e-mail letter to the address biuro@colorato.com.pl or personally at the office address of printing house.

order should provide:

  • Description or number of the order
  • The amount and type of product to mark
  • The identification of Pantone colors
  • A size of printing
  • Artwork files
  • Visualization of the project
  • Terms of order completion
  • Invoice information (in the case of the first order or changing the data)
  • Specification in respect of the packaging
  • Information about the type of shipment (in the case of no-name package service to the final customer) with determining the type of package or pallet and the warehouse document – if the customer would like to obtain a delivery letter by a delivery company to the final customer.

artwork files:

  • Shall be presented in a CDR format or PDF format. When dispatching artwork files in format different than CDR or PDF, printing house does not take any responsibility for potential mistakes occurring during the opening of the files with CorelDraw.
  • Should be presented determining the Pantone colors.
    When saving graphics file with specification of colors different than Pantone Matching System, e.g. CMYK or RGB, the printing house accepts to convert the file into the Pantone system only with the prior agreement of the customer without taking the responsibility for potential differences in colors.
  • Should specify the size of the print.
    In case of lack of size specification of the print, the artwork files need to be saved on a scale of 1:1 and they should be compatible with a given visualization.
    In case of a lack of compatibility, the basis of making print constitutes artwork files.
    Visualization constitutes the basis to specify the place of the print. Any alterations of the print shall be confirmed by another visualization. In case of a lack of visualization changed, the print shall be made in accordance with the initial visualization and artwork files.
    The amount of colors specified shall correspond to the amount of colors sent in artwork file.
    The file to be printed of CMYK colors shall be saved in this way.
  • Shall be sent on a day-ahead. A one-day ahead is considered to be a working day of the printing house from 8am to 4pm.
    In case of a lack of a design or a visualization, there is an option for the customer to have the order executed at an extra charge. The copyrights to the submitted works can be transferred at an extra charge.

The valuation of products is usually free but in justified cases, the printing house reserves the right to alter the valuation of customer’s order (e.g. activation of the promotion articles or additional base) of which the customer must be informed. In case of uncertainty whether a given product is necessary to have an additional base or the activation, the valuation is approximate. The printing house is obliged to inform the customer of altering the valuation and, as a consequence the customer is obliged to bear additional costs. In case of customer’s cancellation of order, the customer shall cover the preparation costs.
Customer’s written acceptance of the valuation of order is equivalent to placing an order and covering the costs of fulfilling the order.
In case of orders that give rise to doubt(prints of CMYK), the printing house shall oblige the customer to accept the proof print made on printing house’s products as well as on the customer’s product. The acceptance shall be affirmed in writing. In case of a lack of written acceptance, the printing house has the right to withhold the production which will cause the order completion shall be automatically postponed.
The keystone of the approval of proof print is “the actual printout”. At the request of the customer, it may be approved after receiving a picture. The printing house shall not be liable for any differences in color between “the actual printout” and the picture.
The approval of the proof print shall occur promptly, that is, within 15 minutes which shall not result in any delays in fulfilling the order. Otherwise, the customer shall cover the preparation costs.
In case of irregular substrates, the printing house reserves the right to use one piece of product in order to perform a test of paint adhesion and heat resistance.
Marketing product should be provided with a surplus.
Cancellation of order or changing of its parameters is possible prior to 24 hours before the scheduled production process.
After processing an order any alteration or cancelation is impossible. In the specific cases, the printing house can take modifications into account. Introducing these changes involves additional costs which should be approved by the customer. If not, the order shall be executed either in its initial version or the printing house may withdraw from the execution of an order.
In case of withdrawal of execution of an order by the printing house as a consequence of alterations made by the customer, the printing house has the right to pass on the production costs to the customer.
The customer declares that the uploaded files are free of computer viruses and shall not cause failure of software and computer facilities.
The printing house shall not be responsible for incorrect preparation of artwork files. The printing house is not obliged to amend or modify the design received by the customer. The file forwarded to the execution of order shall be treated as the final version. The customer shall be liable for any error contained in a file.
The customer shall undertake full legal responsibility for the content and form of provided design and other materials (text and graphics), and also for potential violations of the provisions of the Act of 4 February 1994 on copyright and derivative rights.
The printing house shall have the right to refuse to execute an order which contains illegal content or infringes commonly accepted social norms.
The printing house shall not be obliged to verify the quality and quantity of provided products.
The order completion term shall be determined individually with the technical staff of the printing house..

The order completion term may be extended in the case of:

  • the postponement of delivery of products for marking
  • the postponement of providing the artwork files or visualization
  • introducing any modifications of the design or of the way of order delivery

In the specific cases, the order completion term may be determined individually making an exception to the point 2.7
If there would be further delays in executing an order, the printing house shall immediately inform the customer.
The printing house shall be obliged to inform the customer of the possibility to collect the good at their office or to order the transport by the delivery service.
The printing house cooperates with the courier service Sendit S.A. – www.sendit.pl
All orders are processed and shipped within working days – from Monday to Friday.
The date of delivery is dependent on the courier service and it takes 1-2 days for the product to be delivered in the working days from the moment of dispatch.
The shipment of goods is valid in the territory of Poland only.
The printing house shall not be liable for any losses, costs, damages or delays during shipment or storage.
The customer is obliged to inform the printing house of willingness to insure the package at an extra charge.

Payment

The customer shall not bear the assessment costs.
The customer shall bear the cost of packaging where necessary and after prior notification by the printing house.
The printing house shall not bear the costs of delivery to the customer.
All prices provided in valuation are net prices which must be enlarged by VAT tax at the applicable rate.
The cost of ordering the sample (a single item) of the promotional item shall be included in price list provided to the customer.
Payment for the order of gadget and prints exceeding PLN 10.000 (net price) shall be made by down-payment on printing house’s bank account of 50 per cent of the order value.
The printing house shall not proceed the order until a full payment is received or a confirmation of bank transfer is sent to the e-mail address of the printing house.
Under particularly justified circumstances, the printing house may waive the prepayment.

Payment can be made by:

  • Cash at the registered office of the printing house
  • Bank transfer

An invoice shall be issued on the date of shipment or on the date of receipt of goods by the customer.
Should there be any delay in payment, the printing house shall be entitled to charge statutory interest for every day of delay.
All the invoices shall be sent electronically only. The Customer shall accept to receive invoices and reminders sent by email.
New customers shall be required to pay three first invoices in cash or by prepayment.

Complaints

Complaints should be submitted by e-mail biuro@colorato.com.pl or sent by post within 7 days from the moment of receiving the goods.
Each claim should include detailed description of a non-compliance, the scope of the claim and the invoice number.
The printing house shall assess the validity of the claim on the basis of the forwarded product.
In the event of a complaint regarding differences in color of received product in relation to customer’s expectations, it is necessary to compare the received order to certified proof print that has been made before initiating the project for the customer.
The printing house shall be obliged to consider a complaint within 10 working days from the date of lodging the complaint.
If complaint is accepted, the printing house shall cover the costs of return transportation.
Compensation for claimed goods constitutes the sum of the value of the ordered product with no markup.

Circumstances that shall not give rise to the complaint:

  • minor color variation that is generated in the process of producing an ordered product notwithstanding the technical staff of printing house
  • variation in color between color proofs and computer screen due to technological differences in equipment
  • deviation of register of colors printed consecutively one after another: tolerance 0,2 mm
  • defects of the products intended for marking provided by the customer (colored tags, bleeding fabrics)

Claims made for transport-related damage should be immediately reported to the courier. The acceptance of the complaint relies exclusively on the courier service. The customer shall be obliged to inform the printing house in writing of the situation.

Data Protection

Colorato Bulent Parlak printing house having its registered offices in Poznan, ul. Swarożyca 14A, 61-615 Poznań, under tax identification number 9721171038, statistical identification number 301027233, is to be regarded as the “controller” of the personal data given by the customers when placing an order and providing services electronically. The printing house shall not be liable for any wrong or false data given by the customer, concerning residence address or other data which will hinder or delay the delivery of their order.
The printing house shall process personal data in order to execute customers’ orders or services specified in these Regulations.
The processing of personal data for marketing purposes by the printing house is only permitted if the customer shall give explicit permission in writing.
The customer shall have the right to access their personal data, the right to correct, complete, as well as the right to demand that processing of his personal data be discontinued and the data be deleted.
The printing house shall protect the personal data of the customers from loss, misuse and unauthorized access.
Personal data shall not be transferred or made available to a third parties unless such reporting obligations arise under the applicable laws and regulations.
The printing house may delegate responsibility for the processing personal data on the basis of a written agreement in accordance with the Article 31 of the Act of 29 August 1997 on the Protection of Personal Data.

The Final Provisions

The Regulations may be changed. The customer shall be informed of alterations to the Regulations in electronic form.
In case of altering the Regulations, any order placed before the date of alteration of Regulations shall be executed in accordance with the Regulations applicable on the date and time of order.
In all cases not regulated by these Regulations, legal provisions of civil code, personal data protection act, and copyright act apply.
In case of a dispute between the Parties regarding the interpretation or application of this Agreement, the Parties shall seek a solution by negotiation.
The court appropriate to the registered office of the printing house is the court competent for adjudication of disputes arising between the printing house and the customer.
